Terms of Use

Last updated: October 21, 2026. Tobby is operated by Tobby Inc. By using the app you agree to these terms.

• Age: the app is for adults 18 and older only.
• Zero tolerance: offensive, sexual or violent content is not allowed, nor is harassment, hate, threats, drugs, or anything that endangers a minor. Abusive users are not allowed either.
• Anything that breaks these rules is removed and accounts are suspended (or permanently closed). We review reports within 24 hours.
• Anyone can report a video, live stream, comment, message, story, product or account (⋯ menu → Report) and block anyone they wish.
• Illegal content (no account needed): anyone can notify us at /denunciar. You get a reference number to follow it up.
• If we remove something of yours or suspend your account, we tell you the reason. You can appeal for free for 6 months: in the app (Settings → Moderation and appeals) or, if your account is suspended, at /apelar. A person reviews every appeal. You can also go to court or, in the EU, to a certified out-of-court dispute settlement body.
• Coins, gifts, LIVE and battles: adults 18+ only. The real-money price of coins is always shown before you buy.
• If you live in the EU or the UK, you keep all the rights your local consumer law gives you. Points of contact: /dsa.
• You are responsible for what you upload and stream. You grant us permission to display it within the app and in share links.
• Coins and gifts are virtual: they are not money, cannot be exchanged for money, and are non-refundable, except as required by law or by the Apple/Google store.
• If the shop is active: it connects buyers and sellers, and each seller is responsible for what they sell.
• We may change or discontinue features of the app. If these terms change, we will notify you in the app.
• Copyright: do not upload music, videos or photos that are not yours or that you do not have permission to use. If the owner of a work notifies us that it was uploaded without permission, we take it down and notify the person who uploaded it, who may submit a counter-notification. Repeat infringers' accounts are terminated. To notify us: in the app (⋯ → Report → "Copyright") or by email to tby@tobby.live with: the link, your name and contact information, which work is yours, and a good-faith statement that the use is not authorized, with your signature.

Coins, gifts and Creator Program

• Tobby sells the coins and is the seller. Coins are a limited, personal, non-transferable license to use features of Tobby. They are not money, have no monetary value and are not property: they cannot be redeemed for cash, sold, or transferred to another person or outside Tobby.
• Coins and gifts are not, and may not be used as, a means to send payments or monetary value to creators.
• When you send a gift you use your license to a digital effect of Tobby. It is not a donation or a payment to the creator.
• Purchases are final and non-refundable, except as required by law or by the Apple/Google store. Outside those cases we never refund coins in cash.
• Viewers cannot withdraw anything. Only verified creators admitted by Tobby to its Creator Program receive payments, and only from that program.
• Creators are independent contractors who provide content services (their lives and videos) to Tobby. What Tobby pays them is for those services and comes from Tobby's own funds.
• The points a creator collects measure the popularity of their content; they are not money. The payment is called the Tobby Reward: Tobby sets the formula and the rate, and they may change.
• Until a creator receives a payment, any amount shown in the app belongs to Tobby, and the creator has no claim on amounts accrued before reaching the payout minimum set by Tobby.
• Creator Program payouts have not started yet. When they start, Tobby will make them through Stripe, and we'll announce it in the app first, with its terms. Only gifts sent with purchased coins count; if a purchase is refunded or disputed, it is deducted.
